3 Cette page corrigée remplace la page 39 du document original daté du 1 er décembre 2008 pour refléter l ajout de la contribution au Fonds vert au 1 er janvier DISPOSITIONS GÉNÉRALES 8.1 DISPOSITIONS GÉNÉRALES DU SERVICE DE DISTRIBUTION DROIT AU TARIF LE PLUS AVANTAGEUX Le client a le droit de bénéficier du tarif le plus avantageux, selon les modalités suivantes : a) ce tarif doit être convenu pour toute la durée du contrat sous réserve de modifications subséquentes par entente entre les parties au volume souscrit, à l obligation minimale annuelle et au prix convenu ; b) le client qui n'a pas de contrat peut changer de tarif après entente avec le distributeur TARIF DE DISTRIBUTION PAR DÉFAUT Le tarif D 1 s'applique par défaut DURÉE DU CONTRAT Tout contrat doit être d une durée minimale de 12 mois sauf pour un contrat en service de gaz d appoint pour lequel la durée du contrat peut être inférieure à 12 mois REGROUPEMENT DE CLIENTS Aucun regroupement de clients n est permis au service de distribution CONTRIBUTION - FONDS VERT La «Contribution Fonds vert» issue du Décret du gouvernement du Québec est appliquée comme suit : Pour tous les retraits, le taux unitaire est de 1,156 /m³ ; Un crédit de 1,156 /m³ sera appliqué aux retraits exemptés de la contribution au Fonds vert AJUSTEMENTS SUBSÉQUENTS Les tarifs de distribution sont sujets aux modifications tarifaires décrétées par la Régie de l énergie survenues après la mise en vigueur des présents tarifs pour tenir compte de toute variation des frais d'exploitation découlant de la décision d'une autorité compétente (législateurs, gouvernements et organismes publics) («fait du prince»). 8.2 AUTRES DISPOSITIONS GÉNÉRALES DATE D ENTRÉE EN VIGUEUR Les présents tarifs s'appliquent sur les volumes retirés à compter du 1 er décembre DIFFUSION DES TARIFS Lors de l'entrée en vigueur de nouveaux tarifs, le distributeur doit : a) informer ses clients par écrit de la disponibilité de différents tarifs, de leur droit de bénéficier du tarif de distribution le plus avantageux et d'obtenir une copie des tarifs ; GAZ MÉTRO, TARIFS AU 1 ER JANVIER

5 This corrected page replace page 39 of the original document dated December 1, 2008 to reflect the addition of the Green Fund Contribution effective January 1, GENERAL PROVISIONS 8.1 GENERAL PROVISIONS OF DISTRIBUTION SERVICE RIGHT TO MOST ADVANTAGEOUS TARIFF The customer has the right to avail himself of the most advantageous tariff according to the following conditions: a) The tariff must be agreed upon for the entire contract term, subject to subsequent amendments, agreed to by the parties, to the subscribed volume, the minimum annual obligation and the agreed upon price; b) A customer who has no contract may change tariffs subject to agreement with the distributor DEFAULT DISTRIBUTION TARIFF Tariff D 1 applies by default CONTRACT TERM The term for all contracts must be a minimum of 12 months, except for make-up gas service contracts for which the contract term may be less than 12 months CUSTOMER GROUPINGS Customer groupings are not permitted for distribution service CONTRIBUTION GREEN FUND The Green Fund Contribution required by Decree of the government of Quebec is applied as follows: For all withdrawals, the unit price is /m³; A credit of /m³ will be applied to withdrawals that are exempt from the Green Fund Contribution SUBSEQUENT ADJUSTMENTS The Distribution Tariffs are subject to rate modifications ordered by the Régie de l énergie after they come into force to reflect all variations in operating expenses arising from the decision of a competent authority (legislation, governments, public organizations) ("fait du prince"). 8.2 OTHER GENERAL PROVISIONS EFFECTIVE DATE The Tariffs herein apply to volumes withdrawn as of December 1, COMMUNICATION OF TARIFFS When new Tariffs come into effect, the distributor must: a) Inform customers in writing of the availability of different Tariffs, of their right to avail themselves of the most advantageous Distribution Tariff and to obtain a copy of the Tariffs; b) Send a copy of the Tariffs to all customers under Tariffs D M, D 3, D 4 and D 5.
